Applying for membership to the EFF

I. Information

The EFF accepts as members, national franchise associations only, and only one per country. In case there may be more than one per country, the EFF’s policy is to have as member the single, independent and most representative association in that country.

The EFF has two categories of membership for national associations:

1. FULL members

May become a Full member, any legally constituted, independent and representative national franchise association established in accordance with the laws and customs of their country of origin from within the European Union or a country candidate to the EU or a potential candidate to the EU or a country lying within the geographical boundary described by the foregoing.

In particular, these conditions must be complied with:

a) to accept without reservation the Statutes, the Code of Ethics, the rules and regulations of the association

b) to have as their own members primarily franchise networks comprising the franchisor and its franchisees

c) to have as a governing body one that is primarily composed of franchisors elected by accredited franchisor members

d) to have as Chairman of the national association the representative of an accredited franchise network comprised of the franchisor and the franchisees

e) to operate an accreditation scheme with regular positive checks to ensure that the association’s voting franchise network members comply with the principles of the European Code of Ethics for Franchising

2. AFFILIATE members

May become an Affiliate Member, a national franchise association that, whilst it does not meet conditions of a Full member, commits to and is demonstrably working towards meeting those conditions.

An Affiliate Member is admitted for an initial term of two (2) years, renewable if necessary.

An Affiliate member or its representative may not be appointed to the Board of the association, vote at the General Assembly or use the EFF’s logo.

II. Membership Procedure: List of documents to send to the EFF, in English

1. A letter of Intent from the Chairman of the applying association:

1. This letter of intent of the applicant to join the EFF must be signed by the Chairman [1] of the governing board (ie. the Board of Directors) of the association, expressing the

- the motivations for wishing to join the EFF,
- the express commitment that the association adheres to the values and the principles of the EFF as expressed in the European Code of Ethics on Franchising, and
- the commitment that the respect of the Code of Ethics is also a pre-requisite for the membership of their own franchisor members of the national association.

2. A copy in English of Association’s Statutes, plus copy of the original.

3. The composition of the governing board (ie. Board of Directors), indicating name, company name, company status, and status of its members in the association.

4. Complete list of current members, by category, by name with full contact references.

5. Filling in the EFF’s form indicating your Membership Income structure (see below)

III. The Admission process:

Step 1 Once fully completed, the file is analysed by the Permanent Secretariat. If necessary, it will ask for further information. In this due diligence, the EFF seeks also to assess the independence, representativity and credibility of the applying organisation.
Step 2 The application is submitted respectively to the EFF’s Executive and Policy Boards, which again may require further information.
Step 3 After which the Chairman of the applying association will be invited to make a personal presentation to an upcoming EFF Board meeting in Brussels. The Board will deliberate and decide on whether the application may proceed to Step 4
Step 4 Presentation to the EFF’s General Assembly and vote. The Assembly determines the category of membership accorded and the eventual conditions attached to it. A decision by the GA to admit or refuse a candidate does not have to be justified.
Step 5 The decision is communicated in writing to the applicant.

[1] theEFF Statutes require that the Chairman (or President) of our member associations be a “franchisor”. By franchisor we understand either the founder, or CEO of a franchise company, or the Director (or equivalent) of the Franchise Department of the brand company.
